  • Complaint forum for residents?

    OK, here is an interesting question for you guys....a friend of mine is in a bit of a situation....her husband is doing an ER residendy....



    One of the residents that started in the ER one year ago (not her husband) made a couple of errors in interpreting MIs when he first began fresh out of med school. The director of the ER program is a bit...of a problem...he is a very difficult person to deal with. His solution was to declare this poor guy unteachable and send him to the library instead of allowing him to have any patient contact...for almost a year. Now, he has decided that the resident hasn't improved in patient care...hmmm..and wants to kick the guy out of the program...ruining his career, of course. The man has 3 small children and a wife...and lots of med school debt. The general opinion is that for some reason, he rubbed the chief the wrong way and hasn't been treated fairly.



    Does anyone here know who this resident can go to to file a complaint or get some kind of help? How can she get this information to him without it coming back to get her husband in trouble?



    Any suggestions would be appreciated.

    This is a very easy situation to handle--First the individual needs an employment lawyer



    This is not a joke and if they can not afford one there are non profit legal services out there



    Teh bottom line this man needs to look for precidence--In other words have other people been kicked out of that individual program and if so why.



    i am thinking if this guy did rub the chief the wrong way a very easy solution is at hand



    It is called negligable retention. In other words his legal assistance needs to file suit with the hospital for employing such an ass. The job of an attending or chief is to teach. IF he could get through medical school then he is teachable.



    This is not something to be looked at lightly. E-mail me tomorrow and I can give you more specifics. Being a manager for the public sector, I can tell you I have been in court more times then I would like to admit with people who were trying to sue my employer for wronggul dismissal. More often then not the client won.



    Lawyers vs the establishment--I hate to prescribe it but at this point there is little left to do

      Isn't it the ARC that sets the rules and regulations nation wide for residents and their programs. They say things like work so many hours a week. (haha) Anyway, I know MOST residency programs dislike the ARC as they can put a program on probation or even under if things don't change for the better. They might check into what his rights with the ARC are.

        Devera is such the voice of reason--I love it--Daniel also mentioned that this morning although he does have a friend back home that ran into the same problem. A total personality conflict with the attending with no supporting documentation as to why he was not being passed through the last part of his residency--you will forgive me if I don't have all the terms down--he had just gotten home from a 40 hour shift--anyway the only way he was able to get the hospital to even pay attention to him was to have an employment attorney threaten legal action. The attending was reprimanded and he was passed.



        I am really getting to dislike some of these attendings

          It was the magnanimous decision of the afore-mentioned program to keep this resident on board, citing his remarkable improvement since being banished to the library. Weekly testing by the staff kept track of his progress. We'll see how the next phase--part-time addition to the schedule and part-time studying--goes. I'll keep you posted.

            I have been quite curious. Interestingly, I tried to call you yesterday...but no one was home at the time ... I am really glad to hear that for the sake of his family...Thanks for the update.
