    I'm so upset for you! Is it possible to get an IEP in place instead of the 504? Or will she ignore either? I'm so hopeful the superintendent gets that this is a BIG deal!

      I'm really upset for you too. They certainly would have to change their toon if lawyers got involved. This is exactly the type of thing the statute protects. It is totally irrelevant that no one else wants those tracks, it's insane that they are trying to use fairness as an excuse.

      Hope it gets resolved quickly now that that you've escalated to the next level!

          If you guys haven't already, it might make sense to send a follow up email to the principal recapping your DH's convo - particularly the suggestion of the panel to hear these cases on an individual basis. It's such a well reasoned rational argument/request. I think it would be great to have these suggestions in writing in the event they continue to be unreasonable. Always great to have a paper trail as early as possible.

              Oh, and she was principal of the year in 2014 for hawaii. I've been researching cases against school boards here where schools refused to respect accommodations in 504s and IEPs and everything. It appears that hawaii is a state where they support the school over the rights of the student. There have been some shocking cases which went in the favor of the DOE.

                I don't understand why you'd have a schedule where no one wants 2/3 of the schedule...that seems toxic for everyone.

                  Yeah, my mom taught at a multi-track school for years, and there are definitely better ways to run them than to have two tracks that nobody wants.

                      Yes pollyana- crowding issues. To make it worse once you are in a track you can not switch out. So 3 years with no vacations lining up except for winter break. No met break except for one week between grades. It's ridiculous.

                        They have multi track here to do year round schools - it seems popular. There are 4 tracks. I think one is seen as pretty desirable but I don't think the others are awful. And here they commit to getting all family members in the district in public schools on the same schedule (for family vacation reasons)...seems idiotic otherwise.

                            OMG that is ridiculous and illegal what they are doing. What is the point of having an IEP or 504 of the school is going to ignore it. Have you looked into the state's dept of education to see if they can help support you at all?

                              I have talked to several families now who have run into this problem across the state. It's apparently difficult to get a school to recognize and support the 504 or IEP.

                              At this point I'm connecting with a parent advocacy group, the office of civil rights, the military family school liaison, and also following the DOE recommendations for requesting 504 meetings. Fun times.

                              Dh is contacting the superintendent's office, the 504 coordinator for the state, and anyone else he thinks of.
