    What should I do if we pay a lot of money to live in an apartment & its advertised as luxury but is extremely unsanitary?

    For instance, our underground garage has a rat carcase we've been walking by each day now for over three months & management does not clean it up! We also see bubble gum spit out & stepped on which has been there for sometime. I keep telling management & they get real short & rush me off phone. I also tried calling city inspector & he won't return calls.

    This same exact apartment also offers government subsidies which we didn't learn of until 30 days after signing lease. We kept wondering why apartment which is advertised as luxury & is so expensive was loud with so many kids partying. We later found out we are surrounded by people in same size units who are only paying a small fraction of what we do. When they're loud police do nothing & ditto for management. I tried calling HUD & complaining & still nothing. This has been going on ever since we moved here & we're getting little rest. They finally asked up stairs neighbors to move out but did so without eviction or penalty to their security deposit.

    Its getting quieter but I'm still concerned about sanitation. I've heard rumors you can get diseases from carcases & other things due to an unsanitary environment. Should I call Health & Human Services & report this? That or inspecting general with HUD? It pisses me off realty companies take advantage of federal programs intended for less fortunate people to turn a profit. The service here is lousy & I think its terrible they advertise luxury upscale apartments & offer subsidies quietly at same time. Before we moved here I specifically asked them if this was government subsidized & they said no.

    Their website & lease say nothing about subsidies!!

    if you have e-mails to back up the fact that you actually asked this, and phone records, along w/ no mention on the website, and if Realtor, apt search agent failed to disclose this info, then maybe you have grounds for getting out of your lease...ask an attorney ...heck we have a few legal eagles here so maybe they will chime in...then again maybe someone who has BTDT can offer you some advice!

      Talk to a lawyer. I would look into withholding rent (and/or getting out of your lease earlier). Sometimes it's a bigger hassle to move.

          Dude- that smacks of Eyewitness News "Exposed at Six" or one of those kind of things. contact the TVnews- whichever one seems the most desperate for ratings- it's the local Fox TV show here (that's how I got my 15 minutes of fame)

          Tell them you can show them rat things and they can tape loud arguments-I tell ya it has late night news all over it.

              Do any neighbors have kids? Call child protective services. Evil I know, but might get all neighbors ban together.

                  With the help of a laywer, I'd draft a letter to management explaining why you are withholding rent. There's got to be a clause in your lease agreement about excessive noise, trash, etc. as valid reasons for you as the renter to not have to pay rent.

                    Wouldn't he have to prove said excessive noise? With the cops saying that's perfectly normal, he wouldn't have much of a case. :huh:

                    I'm sorry you're going through this. If you ask, they are required to disclose the fact that they have subsidized units, as well as their number. Unfortunately this migh be a case of their word against yours if you don't have anything in writing denying the existence of subsidized units.

                      I would simply document the instances (dates, times) that it was noisy. And give the dates and times that the police were called. Take pictures of the rats and garbage. That should suffice, but really, my advice would be to consult a lawyer on this! Good luck!

                              If your wife is affiliated with a university program see if the university has free legal advice for students/faculty/staff.
