    MUSKEGON, Mich. — A man who police said entered into a sex pact with his girlfriend and her 15-year-old daughter pleaded no contest to felony sex charges.

    Michael J. Fitzgibbon, 37, also pleaded no contest to more serious sex charges involving sex acts with a 12-year-old girl, a relative.

    Authorities say Fitzgibbon's girlfriend was afraid of losing him while she recuperated from gastric bypass surgery, so she arranged for him to have sex with her daughter for two months.

    All three of them allegedly signed a contract that allowed the girl privileges such as piercings and hair dye in exchange for the sex acts. She testified earlier that she and Fitzgibbon had sex two to three times each week for two months last summer.

    Fitzgibbon faces sentencing for the six counts of criminal sexual conduct on March 23. A no-contest plea is not an admission of guilt but is treated as such at sentencing.

    The girlfriend, whose name is not being made public to protect her daughter's identity, is scheduled to stand trial in February on three counts of criminal sexual conduct.

    Authorities investigated after the 15-year-old told a relative in July. The 12-year-old came forward after charges were filed.
    WEST BRANCH, Michigan — A woman accused of causing her infant daughter's death by feeding her breast milk containing cocaine was sentenced Wednesday to nine months behind bars on a reduced charge.

    Sara Shelby pleaded guilty last month to a charge of attempted manslaughter in the Aug. 21, 2005 death of 5-month-old Karie Lee Bowman. She originally was charged with involuntary manslaughter, a 15-year felony, but agreed to a plea deal with prosecutors in which she would terminate her parental rights to her other child, a 5-year-old daughter. Shelby voluntarily turned over parental rights months ago, defense attorney William Engemann said Wednesday.

    Police said Shelby, a 24-year-old West Branch resident, told them she had used cocaine two or three times the day before her daughter's death.

    A medical examiner ruled that the girl died of cocaine intoxication.

    Ogemaw County Circuit Judge William Baumgartner also ordered Shelby to serve 18 months probation and pay costs totaling $900. If she pays all of her fines, she will receive credit for one month's jail time, said court coordinator Diane Pelts.

    ATLANTA — A man admitted that he tampered with his children's soup in an attempt to get money from Campbell Soup Co., a prosecutor said.

    William Allen Cunningham's 3-year-old son and 18-month-old daughter were hospitalized twice in January 2006. He forced them first to eat soup laced with hot peppers and lighter fluid, and the second time used the prescription drugs Prozac and Amitriptyline — both used to treat depression — to poison the children, authorities said.

    Cunningham, 41, pleaded guilty Tuesday to communicating false claims, U.S. Attorney David Nahmias said. Under terms of a plea agreement, he faces up to five years in federal prison when he is sentenced April 19.

    "He admitted that he put potentially life-threatening foreign substances into soup, which he fed to his two young children and then placed a call to Campbell Soup Co. falsely claiming that the soup had been contaminated," Nahmias said.

    According to prosecutors, Cunningham called Campbell and threatened to sue. Authorities say there was no evidence the soup was tainted when it was bought.

          Police say Albany father burned his toddler with stun gun

          An Albany father is accused of using a stun gun repeatedly on his 18-month-old son causing burns and welts on his entire body.ALBANY, Ore. (KMTR) -

          Police say the toddler's 21-year-old mother came forward Saturday, confessing to officials that her husband, Rian James Wittman, 23, had been abusing their toddler son with a stun gun.

          Police say Rian James Wittman used the device on his child over a three week period.

          "It looks like there were some burns and some welts and things of that nature from where the metal contact points actually made contact with the skin and that's where the electrical current then goes into the body," said Cpt. Eric Carter from the Albany Police Dept.

          Albany police officers brought out the stun gun they took as evidence from Wittman; they said the gun can cause burns that hurt worse and cause more damage than the professional grade tasers they carry.

          "In my 14 years here, this is the first time I can recall we've had a report that someone's used a stun gun on a small child like that...it's just a heart breaking report to have to read," said Cpt. Carter.

          Neighbors who heard about the alleged abuse were shocked and heartbroken.

          "Anybody that can hurt a child, they can't defend themselves, they're defenseless," said Shannon Steel.

          Mindy Sullivan lives just a few doors down from the Wittman's and also has a toddler. She says while there can be moments of frustration, she wouldn't physically reprimand her child.

          "You don't think something like that's going to happen next door," said Mindy Sullivan, "It's very upsetting actually, I can't even imagine what goes through your mind that would make you think that you need to do that. They don't understand what they're doing, they're kids."

          Albany police say the little boy suffered burns and welts on his arms, stomach, back and legs, but he is expected to be okay.

          As for his father, he's being held in the Linn County Jail on charges of second degree assault and criminal mistreatment.

          This is when I begin to think that some people just shouldn't be allowed to have kids...

              The good news here is that 'back in the day' things would have been dealt with privately, if at all.

              At least now these scumbags are being openly prosecuted. It's not 'defer to the parent' which is how child abuse used to be dealt with.

                Man pleads no contest to 'sex pact' charges

                Muskegon County Circuit Judge Timothy G. Hicks accepted the pleas.

                In the case involving the 15-year-old, Fitzgibbon pleaded no contest to four counts of third-degree criminal sexual conduct with a person between the ages of 13 and 15. Two other counts were dismissed.

                In the case involving the 12-year-old, he pleaded no contest to two counts of first-degree criminal sexual conduct with a person younger than 13. Four other counts were dismissed.

                The girlfriend, whose name is not being made public to protect her daughter's identity, has been charged with three counts of third-degree criminal sexual conduct with a person between the ages of 13 and 15. Her jury trial is scheduled to begin Feb. 21.

                Police said the woman was afraid of losing her boyfriend while recuperating from the surgery, so she agreed in writing to allow her daughter to be Fitzgibbon's sex partner during that time.

                In exchange, the girl would get privileges such as new clothing, piercings and hair dye

                  "A reasonably prudent person can conclude that boy would have died, given the exposure and his body weight," said Detective Chris Olson, who added that the boy's body temperature was measured at 94.5 degrees. "It would have been not more than several more minutes.

                  "This was egregious. We're all shaking our heads in disgust about it."

                  Dr. Mary Ann McNeil, director of the department of emergency medicine for the University of Minnesota Medical School, said that "94 is pretty terrible. He's getting into the life-threatening [range] at 94 and 93."Kids cool off much quicker than adults do," said McNeil, who was speaking in general terms and not directly about this case. "The reason is the body mass compared to the skin kids have is uneven, way more skin than body mass."

                  Olson added that such incidents at Mystic Lake happen "a few times a year, but not all the time."

                  Early Thursday, shortly after midnight, a casino patron found the boy wandering in the parking lot, police said. The temperature was minus-7 degrees with a minus-22- degree windchill at the time.

                  The father drove arrived at the casino at 10:51 p.m. Wednesday, police determined, based on parking lot video surveillance. The boy was brought to security at 12:14 a.m., Olson said.

                  The father was found in the casino and interviewed, Olson said, and he gave a false name and birthdate. Later, he admitted to authorities that he left the boy in the vehicle.

                  The child was taken to St. Francis Hospital in Shakopee, where he was treated and released. His father was jailed. Police recommended charges of child endangerment and give false information to police.

                  Mild hypothermia, the first stage, is clinically defined as body core temperatures between 96.8 and 91.4 Fahrenheit.
